Terms of Service

Please read these Terms of Service ("Terms") before ordering any product using the www.meteosource.com website ("Service") operated by IFYS, Ltd ("Company"). By accepting these Terms of Service or by using the Service in any manner, you and the entity you represent ("Customer") agree that you have read and agree to be bound by this agreement to the exclusion of all other terms.

Basis Of Contract

A Customer's request through this Website for the provision of the Subscription Services constitutes an offer by the Customer to purchase the Services in accordance with these Terms and any other applicable legal documents referred to herein. The Customer's request shall only be deemed to be accepted if the Company has received cleared payment in full.

The Company shall, during the Subscription Term, use reasonable endeavours to provide the Services in accordance with the Subscription Plan in all material respects and subject to these Terms. Your use of the Service is at your sole risk. The service is provided on an "as is" basis.

Prices of all Services are subject to change upon 30 days notice from the Company. Such notice may be provided at any time by posting the changes to the meteosource.com and sending the notice to registered users in advance via e-mail.

Services and Data

The Customer is permitted solely to use Meteosource API for reference by Your end users. Except as expressly provided herein, under no circumstances whatsoever may You transfer or permit the transfer of Meteosource API outside of your application(s).

You shall not make access to the Meteosource API available to unauthorized parties.

The Customer understand and agree that the Company shall not be liable for any damages or losses resulting from your use of the API or third-party products that access data via the API.

Abuse or excessively frequent requests to the Service via the API may result in the temporary or permanent suspension of Customer's account access to the API. The Company, in its sole discretion, will determine abuse or excessive usage of the API. The Company will make a reasonable attempt via email to warn the account owner prior to suspension.

The Customer shall further co-operate with the Company in all matters relating to the Services; and provide in a timely manner such information as the Company may request, and ensure that such information is accurate.

Payment, Refunds, Upgrading and Downgrading Terms

Customer is billed automatically via credit card, PayPal, or invoiced for payment, depending on the Service plan. The number of API calls purchased by Customer in the Service plan must be used during the applicable term and any unused Pageviews at the end of such term are forfeited. In the event the usage of API calls exceeds the Service plan a Customer selected during a term, the Company will charge additional overage fees and the Customer shall be obligated to pay any overage fees as explained at pricing page.

Upgrade or downgrade in the Service plan level will result in the new rate being charged at the next billing cycle. Downgrading your Service may cause the loss of features or capacity of your account. The Company does not accept any liability for such loss.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. Where required, The Company will collect those taxes on behalf of taxing authority and remit those taxes to taxing authorities.

Our online order process is conducted by our reseller Paddle.com. Paddle.com is the Merchant of Record for most of our orders. Paddle provides customer service inquiries and handles returns.

Cancellation and Termination

You are solely responsible for properly cancelling your account. An email to cancel your account is not considered cancellation. You can cancel your account at any time by clicking on the link in Administration area.

If you cancel the Service before the end of your current paid up month, your cancellation will take effect at the end of the current billing cycle, and you will not be charged again. But there will not be any prorating of unused time in the last billing cycle.

Technical support

Technical support is provided by email to paying Customers. Email responses are provided on the reasonable effort basis without guaranteed response time. You understand that the Company may access your account, or information associated with your account, to provide support or maintenance, or for security-related reasons.

Force Majeure

The Company shall have no liability to the Customer under the Terms if it is prevented from or delayed in performing its obligations under the Terms, or from carrying on its business, by acts, events, omissions or accidents beyond its reasonable control, including, without limitation, strikes, lock-outs or other industrial disputes, failure of a utility service or transport or telecommunications network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of meteosource or sub-contractors, provided that the Customer is notified of such an event and its expected duration.
